Please note Car Transport Quoter retains the sole discretion, to modify or revise these Terms at any time by updating this page or pages. Users are automatically bound by any modifications published. Our Commitment to you Car Transport Quoter will provide a booking service that will facilitate multiple quotes for each car movement requirement placed via our system. We will endeavour to ensure this process operates efficiently and in a timely fashion. We promise to use our extensive experience, skill and care to provide a world class service level at all times. Website Warranties The Car Transport Quoter website and materials contained therein are provided on an "AS IS" basis and is without any warranties of any kind, either express or implied. Although we take precautions, the Car Transport Quoter website contains data provided by third parties, and therefore Car Transport Quoter will not and cannot be held responsible for any third party material. Car Transport Quoter disclaims all warranties, included but not limited to warranties of title, quality, accuracy, suitability, completeness, fitness for a particular purpose, freedom from viruses and non-infringement of third party rights. Website Security During registration you selected a username and password to access the Car Transport Quoter application. These are essential for your secure use of the service and to protect your identity. You must ensure that they are kept confidential, secure and are used in accordance with all relevant instructions. If we believe there has been or is likely to be a breach of security or misuse of the service we may: (a) change your password and then we will notify you that we have done this; and/or (b) suspend username and password access to the service If you think that any username or password has become known by someone not authorised to use it, or if any password is being or is likely to be used in an unauthorised way, you need to inform us immediately. We provide you with a web based application service, and any associated software is only provided for your use only in a web browser. You do not own or have any rights or claims to software code, the application, or any business logic or otherwise. You may not copy, distribute, sub-license the service (or any part of it) or the associated software to anyone else. Website Service Level We aim to provide a 24 x 7 service but may need to temporarily suspend the service for operational reasons (e.g. for repairs, planned maintenance or upgrades). If service suspension is required we promise to restore the service as soon as possible. Although we attempt to provide you with the best possible service, we cannot guarantee that the service will never be faulty. However, we will correct all reported faults as soon as we reasonably can. Car Transport Quoter authorises you to view the Material on the website as a booking service in order to move your vehicles within the UK. If you violate any of these Terms, your permission to use the Material automatically terminates and you must immediately destroy any copies of the Material you have made. Disclaimer of Damages & Limitation of Liability Your use of the Car Transport Quoter website is at your own risk. Car Transport Quoter acts only as a booking agent between you and third parties and therefore has no liability nor accepts liability for any loss, personal injury or death however incurred. If you are dissatisfied with any of the website materials, contents, these Terms of Use, our Terms and Conditions, our Privacy Policy or any other policies stated, your sole remedy is to discontinue use of the website. When you book arrangements or services via the website your contract will be with the supplier or arranger of those arrangements or services and not with Car Transport Quoter, and will be subject to the terms and conditions of that relevant service provider. We do not have any liability of any sort (including liability for negligence) for the acts or omissions of other providers such as transport companies or others services promised or committed to either verbally or in writing. It is the website user, the owner of the vehicle, the requestor of a delivery service responsibility to undertake the appropriate due diligence before agreeing to; engaging with; or releasing your vehicle/s or cars to any 3 party providing you with the transportation service or otherwise. This includes necessary insurances, road user and licensing laws. Car Transport Quoter do not provide any insurance for vehicles whatsoever and will not undertake storage, transportation or any other service that passes liability to Car Transport Quoter unless agreed in writing. We will accept no liability (whether in negligence or otherwise) for any loss, loss of opportunity, goodwill, reputation, business, revenue, profit, or savings you expected to make, wasted expenditure or data being lost or corrupted. The disclaimer and limitation includes direct, indirect, incidental, special, consequential or exemplary damages and applies whether based on warranty, contract, tort (including negligence), common law or statute, regardless of whether Car Transport Quoter is advised of the possibility of such damages. Public & User Submissions - General The Car Transport Quoter website includes listings, postings, stories, and articles from third parties. Such content is the responsibility of the third party creator of the content. Car Transport Quoter has no responsibility for such content and is merely providing access to such content as a service to you. While Car Transport Quoter will endeavour to remove any offensive or harmful content from the website as soon as it comes to our attention, third party materials may include offensive, inappropriate, harmful, or deceptive information. However, we do expect users to use all caution and common sense when using third party data and validate where necessary. Some content from third parties such as our transport partners etc. will have their own terms and conditions. These may be displayed online or elsewhere. If you access our or their content you will need to comply with those terms and conditions. If any of the information you give to us when you sign up for the service changes, including any changes to your email address, payment details, you must inform us immediately. You are responsible for checking the communication channels such as email and the web application sent to the email address you provided and for monitoring and replying to all correspondence from our third parties in a timely fashion. You agree that you are responsible for your own submissions and postings and for any consequences thereof. Car Transport Quoter reserves the right to terminate or restrict your access to any or all Membership or Subscriptions privileges at any time without notice for any reason whatsoever. These links are provided solely as a convenience to our users, and are not necessarily an endorsement by Car Transport Quoter of the contents on such third-party websites. Indemnity You agree to defend, indemnify and hold harmless the Car Transport Quoter website, Car Transport Quoter, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal fees, alleging or resulting from your use of the Material or your breach of the terms of this Agreement. Car Transport Quoter will provide notice to you promptly of any such claim, suit, or proceeding and shall reasonably assist you, at your expense, in defending any such claim, suit or proceeding. This indemnity shall survive termination of the Agreement. General Disclaimer Car Transport Quoter makes no claims that the materials presented are appropriate for any particular purpose or audience. Access to the materials may not be legal by certain persons. If you access the website from outside of the United Kingdom, you are responsible for compliance with the laws of your jurisdiction. Termination Car Transport Quoter reserves the right to cease operating the whole or any part of the website at any time. The termination of this Agreement (for any reason) shall; (i) be without prejudice to any other rights or remedies which Car Transport Quoter may be entitled to under this Agreement or at law; (ii) not affect any accrued rights or liabilities which Car Transport Quoter may then have; and (iii) not affect the coming into or continuance in force of any provision of this Agreement which is expressly or by implication intended to come into or continue in force after such termination. All legal issues arising from or related to the use of the website shall be construed in accordance with and determined by English Law. Policy on Booking fees, Deposits, Payments and Invoices Car Transport Quoter may request a booking deposit or full payment to secure the necessary vehicle transport or delivery resource required to move your vehicle(s). When requested an invoice will be emailed to you. Any deposit will be deducted from the quoted amount to move your vehicle(s) payable on delivery or otherwise agreed. Policy on Cancellations and Refunds Car Transport Quoter may take a booking fee or full payment on behalf of a transport partner. A full payment refund will only be provided if written notification is received 3 business days (72 hours) prior to 8am of the agreed collection date. A 50% refund of a full payment will be provided if written notification is received 2 business days (48 hours) prior 8am of the agreed collection date. You hereby accept and irrevocably submit to the non-exclusive jurisdiction of the English courts. |
